🏛️ What To Do When A Loved One Passes Away – Legal Steps in Estate Administration

✍️ Step 1: Locate the Will (If Any)

The first legal step is to determine whether the deceased had prepared a will.

  • If a will exists, it should name an executor to manage the estate.

  • If no will is found, the estate will be handled under intestacy laws, and next of kin may apply to become the administrator.


📜 Step 2: Apply for Grant of Probate or Letters of Administration

  • Grant of Probate:If a valid will is available, the executor named in the will must apply to the High Court to obtain a Grant of Probate. This document gives legal authority to administer the estate.

  • Letters of Administration:If there is no will, an eligible family member may apply for Letters of Administration. The High Court will appoint an administrator to handle the estate according to the Distribution Act 1958.

Both applications require:

  • Death certificate

  • Identity documents of the deceased and applicant

  • Asset listings (bank accounts, properties, investments, etc.)

Once the Grant of Probate or Letters of Administration is obtained:

  1. Assets and liabilities of the estate must be identified and valued.

  2. Debts and taxes must be settled first.

  3. The remaining estate will be distributed to the rightful beneficiaries as per:

    • The will (if any); or

    • The Distribution Act 1958 (if no will).
